Society’s relationship with modern animal farming is an ambivalent one: on the one hand there is rising criticism about modern animal farming; on the other hand people appreciate certain aspects of it, such as increased food safety and low food prices. This ambivalence reflects the two faces of modernity: the negative (exploitation of nature and loss of traditions) and the positive (progress, convenience, and efficiency). This article draws on a national survey carried out in the Netherlands that aimed at gaining (...) a deeper understanding about the acceptance of modern dairy farming in Dutch society. People take two dimensions into account when evaluating different aspects of modern dairy farming: (1) the way living beings are used for production and (2) the way a dairy farm functions as a business. In both these dimensions people appeared to adopt cautious opinions: most people preferred relatively traditional and natural farms and were concerned about the use of nature and treatment of animals in modern production—although this did not imply an outright rejection of modern animal farming. The study also looked for (and sought to explain) differences of opinion between social groups. Besides socio-demographic factors such as age and gender, farming experience and value-orientation (such as socially minded and professional) appeared to be important variables. The values and convictions within modern society can help to explain why some people are greatly concerned about animal welfare while some show less concern. This diversity also helps to explain why general information campaigns are quite ineffective in allaying concerns about modern animal farming. (shrink)

Based on the reconstruction of the development of 14 food supply chain initiatives in 7 European countries, we developed a conceptual framework that demonstrates that the process of increasing the sustainability of food supply chains is rooted in strategic choices regarding governance , embedding, and marketing and in the coordination of these three dimensions that are inextricably interrelated. The framework also shows that when seeking to further develop an initiative (e.g., through scaling up or product diversification) these interrelations need continuous (...) rebalancing. We argue that the framework can serve different purposes: it can be used as an analytical tool by researchers studying food supply chain dynamics, as a policy tool by policymakers that want to support the development of sustainable food supply chains, and as a reflexive tool by practitioners and their advisors to help them to position themselves, develop a clear strategy, find the right allies, develop their skills, and build the capacities that they need. In this paper, we elaborate upon the latter function of the framework and illustrate this briefly with empirical evidence from three of the initiatives that we studied. (shrink)

The Dutch law states that a physician may perform euthanasia according to a written advance euthanasia directive when a patient is incompetent as long as all legal criteria of due care are met. This may also hold for patients with advanced dementia. We investigated the differing opinions of physicians and members of the general public on the acceptability of euthanasia in patients with advanced dementia.

Many studies have addressed the justice of public land acquisition, but few studies have addressed the question of what landowners perceive as just. Individual perceptions drive an important part of the social and scientific debates on legitimate and just land acquisition. This article addresses this gap by studying landowners’ and land purchasers’ perceptions of just land acquisition. We did this by uncovering the prevailing discourse on just land acquisition and studying the values that shaped people’s perceptions of just land acquisition. (...) The results showed that perceptions of justice are based on the values of lawfulness, decentness and equality. These values were translated into different norms that resulted in expectations pertaining to just land acquisition. The present study investigated the extent to which moral disengagement and the tendency to consider moral rules as socio-conventional rules are distinct dimensions of morality, and their association with three different forms of participation in bullying. These two types of moral cognitions have been theorized in different models of morality and are usually studied independently, even if research on moral shifts suggests some possible overlaps. A group of 276 Italian students from primary and middle school completed self-reports assessing moral disengagement, (...) socio-conventional perception of moral rules, and participation in bullying as bully, defender of the victim and passive bystander. Results from structural equation modeling analysis confirmed that moral disengagement and socio-conventional comprehension of aggressions are separate and moderately connected morality dimensions. Controlling for age, gender and SES, only moral disengagement was positively associated with perpetrating bullying. These results point to moral disengagement as the critical component of moral cognitions to be addressed in interventions. (shrink)

Background In the EU, clinical assessors, rapporteurs and the Committee for Medicinal Products for Human Use are obliged to assess the ethical aspects of a clinical development program and include major ethical flaws in the marketing authorization deliberation processes. To this date, we know very little about the manner that these regulators put this obligation into action. In this paper, we intend to look into the manner and the extent that ethical issues discovered during inspection have reached the deliberation processes. (...) Methods To gather data, we used the Dutch Medicines Evaluation Board database and first searched for the inspections, and their accompanying site inspection reports and integrated inspection reports, related to central marketing authorization applications of drugs submitted to the European Medicines Agency from 2011 to 2015. We then extracted inspection findings that were purely of ethical nature, i.e., those that did not affect the benefit/risk balance of the study. Only findings graded at least major by the inspectorate were included. Lastly, to identify how many of the ethically relevant findings reach the application deliberation processes, we extracted the relevant joint response assessment reports and reviewed the sections that discussed inspection findings. Results From 2011 to 2015, there were 390 processed applications, of which 65 had inspection reports and integrated inspection reports accessible via the database of the Dutch Medicines Evaluation Board. Of the 65, we found ERFs in 37. The majority of the ERFs were graded as major and half of the time it was informed-consent related. A third of these findings were related to research ethics committee processes and requirements. Of the 37 inspections with ERFs, 30 were endorsed in the integrated inspection reports as generally GCP compliant. Day 150 joint response assessment reports and Day 180 list of outstanding issues were reviewed for all 37 inspections, and none of the ERFs were carried over in any of the assessment reports or list of outstanding issues. Conclusion None of the ethically relevant findings, all of which were graded as major or critical in integrated inspection reports, were explicitly carried over to the joint assessment reports. This calls for more transparency in EMA application deliberations on how ERFs are considered, if at all, in the decision-making processes. (shrink)

Philosophical arguments often assume that the folk tends towards moral objectivism. Although recent psychological studies have indicated that lay persons’ attitudes to morality are best characterized in terms of non-objectivism-leaning pluralism, it has been maintained that the folk may be committed to moral objectivism _implicitly_. Since the studies conducted so far almost exclusively assessed subjects’ metaethical attitudes via explicit cognitions, the strength of this rebuttal remains unclear. The current study attempts to test the folk’s implicit metaethical commitments. We present results (...) of a newly developed Implicit Association Test (IAT) for metaethical attitudes which indicate that the folk generally tend towards moral non-objectivism on the implicit level as well. Experiences are interpreted as conscious mental occurrences that are of phenomenal character. There is already a kind of (weak) intentionality involved with this phenomenal interpretation. A stricter conception of experiences distinguishes between purely phenomenal experiences and intentional experiences in a narrow sense. Wittgenstein’s account of psychological (experiential) verbs is taken over: Usually, expressing mental states verbally is not describing them. According to this, I believe can be seen as an expression of one’s own belief, but not as an expression of (...) a belief about one’s belief. Hence, the utterance I believe it is raining shows that I believe that it is raining, although it is not said by these words that I believe that it is raining. Thinking thoughts such as I believe it is raining, but it is not raining (a variant of Moore’s paradox) is an absurdity between what is already said by silently uttering It is not raining and what is shown by silently uttering I believe it is raining. The paper agrees with a main result of Wittgenstein’s considerations of Moore’s paradox, namely the view that logical structure, deducibility, and consistency cannot be reduced solely to propositions—besides a logic of propositions, there is, for example, a logic of assertions and of imperatives, respectively. Alexius Meinong's specific use of the term "self-presentation" had a significant influence on modern epistemology and philosophical psychology. To show that there are remarkable parallels between Meinong's account of the self-presentation of experiences and Lehrer's account of the exemplarization of experiences is one of this paper's main objectives. Another objective is to put forward some comments and critical remarks to Lehrer's approach. One of the main problems can be expressed by the following: The process of using a particular experience as (...) a sample, that is, an exemplar that we use to stand for and refer to a plurality of experiences, Lehrer calls "exemplarization". As concrete experiences are multifarious (red and round, for example), how can we single out a specific sort of experiences (the red ones) by the process of exemplarization when we use such a multifarious experience as a sample? Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

States may be compared with respect to normality, or some preference criterium, or similarity to some given (set of) state(s). Theories may be compared with respect to logical power, or to truthlikeness, or to how well they capture certain information. A continuing need for care for elderly, combined with looser family structures prompt the question what filial obligations are. Do adult children of elderly have a duty to care? Several theories of filial obligation are reviewed. The reciprocity argument is not sensitive to the parent–child relationship after childhood. A theory of friendship does not offer a correct parallel for the relationship between adult child and elderly parent. Arguments based on need or vulnerability run the risk of being unjust to those (...) on whom a needs-based claim is laid. To compare filial obligations with promises makes too much of parents’ expectations, however reasonable they may be. The good of being in an unchosen relationship seems the best basis for filial obligations, with an according duty to maintain the relationship when possible. We suggest this relationship should be maintained even if one of the parties is no longer capable of consciously contributing to it. We argue that this entails a duty to care about one’s parents, not for one’s parents. This implies that care for the elderly is not in the first place a task for adult children. (shrink)

We investigate the epistemological consequences of a positive polymerase chain reaction SARS-CoV test for two relevant hypotheses: V is the hypothesis that an individual has been infected with SARS-CoV-2; C is the hypothesis that SARS-CoV-2 is the cause of flu-like symptoms in a given patient. We ask two fundamental epistemological questions regarding each hypothesis: First, how much confirmation does a positive test lend to each hypothesis? Second, how much evidence does a positive test provide for each hypothesis against its negation? (...) We respond to each question within a formal Bayesian framework. We construe degree of confirmation as the difference between the posterior probability of the hypothesis and its prior, and the strength of evidence for a hypothesis against its alternative in terms of their likelihood ratio. We find that test specificity—and coinfection probabilities when making inferences about C—were key determinants of confirmation and evidence. Tests with 8) for V against ¬V regardless of sensitivity. Accordingly, low specificity tests could not provide strong evidence in favor of C in all plausible scenarios modeled. We also show how a positive influenza A test disconfirms C and provides weak evidence against C in dependence on the probability that the patient is influenza A infected given that his/her symptoms are not caused by SARS-CoV-2. Our analysis points out some caveats that should be considered when attributing symptoms or death of a positively tested patient to SARS-CoV-2. (shrink)

BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. Although law is established on a strong presumption that persons younger than a certain age are not competent to consent, statutory age limits for asking children’s consent to clinical research differ widely internationally. From a clinical perspective, competence is assumed to involve many factors including the developmental stage, the influence of parents and peers, and life experience. We examined potential determining factors for children’s competence to consent to clinical research and to what extent they explain the variation in competence judgments.

A target question for the scientific study of consciousness is how dimensions of consciousness, such as the ability to feel pain and pleasure or reflect on one’s own experience, vary in different states and animal species. Considering the tight link between consciousness and moral status, answers to these questions have implications for law and ethics. Here we point out that given this link, the scientific community studying consciousness may face implicit pressure to carry out certain research programs or interpret results (...) in ways that justify current norms rather than challenge them. We show that because consciousness largely determines moral status, the use of nonhuman animals in the scientific study of consciousness introduces a direct conflict between scientific relevance and ethics—the more scientifically valuable an animal model is for studying consciousness, the more difficult it becomes to ethically justify compromises to its well-being for consciousness research. Finally, in light of these considerations, we call for a discussion of the immediate ethical corollaries of the body of knowledge that has accumulated and for a more explicit consideration of the role of ideology and ethics in the scientific study of consciousness. Julian of Norwich (1342–ca.1416) as a post-scholastic theologian. This article positions the ‘first female English writer from the Middle Ages’, Julian of Norwich (1342–ca.1416), within the context of ‘post-scholasticism’, the very last period in late Medieval Philosophy, of which one feature was the final separation of theology and philosophy in the late Medieval index. Julian should in terms of this placing be engaged as a theologian proper, distinguished from the six other prominent female thinkers from the Medieval Latin West (Héloïse, (...) Hildegard, Mechtild, Hadewijch, Marguerite and Catherine), who were all philosopher-theologians. However, Julian’s epistemology and metaphysics were intertwined with her theology, as presented in her Book of Showings, to such an extent that it is impossible to isolate it from her theological output. She is within the socio-historical context of the third wave of the Black Plague in Norwich in 1369 henceforth profiled as a ‘post-scholastic theologian’ and presented on the basis of prominent theological features in Showings, including its immanent-mystical character (being a presentation of convent theology rather than scholastic theology), its vernacular (Middle English) originality and profound pastoral appeal, its maternal-Christological imagery (Moder Jhesu), its Trinitarian orientation (for the trinitie is god, god is the trinitie) and its deeply eschatological, open-ended engagement with a world devastated by the Plague (alle shalle be wele). Contribution: As a millennium-long discourse, Medieval philosophy functions in a Venn diagrammatical relationship with Medieval history, Church history, patristics and philosophy of religion. Whenever ‘mainstream’ or ‘canonised’ Medieval philosophy is impacted from specialist research, it may well have implications that these closely related disciplines could take note of. Such is the case in this reappraisal of Julian of Norwich’ theological and pastoral legacy from its original context of the Black Plague in the 14th century – and indeed within the context of the Covid-19 pandemic in 2020. Semmelweis’s work predates the discovery of the power of randomization in medicine by almost a century. Although Semmelweis would not have consciously used a randomized controlled trial (RCT), some features of his material—the allocation of patients to the first and second clinics—did involve what was in fact a randomization, though this was not realised at the time. This article begins by explaining why Semmelweis’s methodology, nevertheless, did not amount to the use of a RCT. It then shows why it is (...) descriptively and normatively interesting to compare what he did with the modern approach using RCTs. The argumentation centres on causal inferences and the contrast between Semmelweis’s causal concept and that deployed by many advocates of RCTs. It is argued that Semmelweis’s approach has implications for matters of explanation and medical practice. (shrink)

IRBs and REBs use specialized language. A process of definition and re-definition of the situation occurs. That process of interpretation can usefully be considered from the perspective of interpretive social science models involving Symbolic Interaction, Semiotics and Hermeneutics. Seven examples are provided to flesh out the nuances of contextual decision making and the “casuistic” aspects of a balanced approach to complex problems. While many decisions are relatively unproblematic and can follow a template, it is not possible simply to apply a (...) fixed and mechanical approach. Hence, a socialization process occurs in which committee members must learn the actual application of the rules as opposed to the formal requirements. A “tightrope” between overly rigid and overly lax interpretations must be crossed and the more we understand the process of semiosis and the semiotic context the more likely it will be that truly ethical decisions will be “accomplished.” The lack of adequate survey data makes it all the more important to have good theoretical understanding of process. Presque tous les interprètes considèrent qu’il va de soi qu’en Physique Β, 1, 192b8-193a9, Aristote présente ce qui constitue le cœur de sa propre théorie de la nature et des choses naturelles, par opposition à d’autres théories dont il avait connaissance. La question de savoir si, avec ses deux définitions, il renvoie à un principe actif, à un principe passif ou à quelque chose d’autre, a par ailleurs fait l’objet de discussions. Dans cet article, je cherche à montrer qu’en 192b8-193a9, (...) il ne met pas en place sa propre théorie, mais ne fait que préparer le terrain pour le déploiement d’une théorie, et qu’à l’évidence il renvoie à un principe actif, moteur. En outre, je montre comment il élabore au cours de Physique Β sa réponse à la question principale d’une théorie de la nature et des choses naturelles au niveau le plus général, et en quoi cette réponse est constitutive pour sa biologie. Paul Ricœur laisse comme testament une œuvre immense.Elle est justement saluée aujourd'hui pour s'être confrontée aux principaux enjeux intellectuels du XXe siècle, sans jamais cesser de dialoguer pour autant avec le "grand livre de la philosophie". A travers la diversité des thématiques abordées par le philosophe, cet ouvrage nous éclaire sur ce qui fait la trame et le moteur de cette pensée en mouvement : une réflexion sur l'homme en tant qu'être agissant.L'auteur propose de reconfigurer le parcours de cette philosophie (...) de l'agir humain en suivant trois perspectives à la fois distinctes et complémentaires. Selon une première perspective, il s'agit de retracer la genèse d'une anthropologie philosophique qui porte sur les fondamentaux de l'agir humain. Selon une deuxième perspective, l'auteur cherche à resituer l'épistémologie de Paul Ricœur, ressourcée dans la tradition herméneutique, au contact des sciences de l'homme.Selon une troisième perspective, il s'agit de reconstituer les jalons d'une philosophie normative qui ouvre la morale, le politique, la justice et le droit à l'horizon de l'universalité, sans dénier l'incarnation de l'agir humain dans un "monde de la vie" déjà structuré par des valeurs. A l'opposé d'une rhétorique hagiographique ou d'une critique systématique, la "juste distance" prise par l'auteur permet de restituer l'unité profonde de l'œuvre ricoeurienne et d'en dévoiler en même temps les tensions et les paradoxes.Cet ouvrage accorde une large place à la réception philosophique du travail de Paul Ricœur sur l'agir humain en le présentant comme une "œuvre ouverte", élevée au "conflit des interprétations". This book offers a sustained analysis of the key concepts discussed in the works: existence and the ethical, truth and subjectivity, indirect communication, guilt and suffering, irony and humour, reason and paradox, and faith and history.

This article reconsiders the historical–philosophical significance of the monk and abbot of Corbie Abbey (est. 657), Paschasius Radbertus (c. 790–860). Radbert is contextualised within the cultural and academic setting of the Carolingian period of the eighth and ninth centuries while taking into account the diverse scholarly accomplishments of his contemporaries such as Alcuin of York (c. 740–804), Rabanus Maurus (c. 780–856), Walafrid Strabo (c. 809–849) and John Scottus Eriugena (815–877). The characteristic absence of contributions regarding Radbert in otherwise comprehensive introductions (...) and editorial works in medieval philosophy is subsequently surveyed. It is shown that only a few introductory works of note contain references to Radbert, while the current specialised research is also relatively limited. Reconsidering depictions of Radbert in several older commentaries, notably Martin Grabmann’s (1875–1949) Die Geschichte der Scholastischen Methode I ( 1957 ), it is suggested that Radbert’s philosophical importance could be traced to Vorscholastik or the earliest development of scholasticism, as presented in his extensive commentary Expositio in Matheo Libri XII – without diminishing the ecclesiastical weight of his dispute with Ratramnus (d.c. 868) regarding their interpretation of the Eucharist in their similarly titled but disparate treatises De corpore et sanguine Domini, for which Radbert is generally better known and accordingly reflected in studies of early medieval intellectual history. Contribution: This article contributes to scholarship in early medieval philosophy by reassessing the philosophical influence of Paschasius Radbertus, based on the most recent specialised analyses and older modern receptions of his texts De corpore et sanguine Domini and Expositio in Matheo Libri XII. Tout l'arc de la production fichteenne est sous-tendu par l'effort de decrypter le chiffre de la Grande Revolution de 1789 et d'en conjurer l'echec. Le lecteur pourra reparcourir les differentes etapes de la complexe relation amour-haine que le philosophe allemand a entretenu avec la France, au fil de ce recueil qui reunit pour la premiere fois l'ensemble des jugements qu'il a portes sur la France et les Francais (comprenant quelques inedits), depuis son vigoureux engagement au service des ideaux revolutionnaires jusqu'a (...) son virulent engagement anti-napoleonien. Par-dela l'interet historique ou anecdotique que l'on peut concevoir a examiner la position de celui que l'on peut a juste droit qualifier de philosophe de la Revolution par excellence, se profile un interet proprement philosophique: derriere la question de la coherence de la lecture par Fichte du drame qui s'est joue au tournant du XIXe siecle, c'est la consistance de la philosophie de l'histoire et de sa conception de l'articulation entre la theorie et la pratique qui est en cause. De plus, comme les blessures ouvertes par la Revolution ne sont pas encore refermees, le disgnostic qu'il a prononce sur les insuffisances des principes qui l'ont guidee ne peut laisser indifferent. As behavioural economics reveals, human decision-making deviates from neoclassical assumptions about human behaviour and people (often) fail to make the ‘right’ welfare-enhancing choice. The purpose of Sunstein and Thaler’s concept of ‘nudge’ is to improve individual welfare. To provide normative justification, they argue that the only relevant normative criterion is whether the individual is ‘better off as judged by themselves’, so that the direction in which people are to be nudged is defined by their own preferences. In light of behavioural (...) findings, however, people’s choices do not provide a sound basis for eliciting preferences and thus for assessing welfare. In this paper, I aim to challenge Sunstein and Thaler’s normative view, arguing that it is unreasonable to rely on conventional welfare economics, particularly considering the given context. Sunstein and Thaler depend on an approach of ‘preference purification’ which assumes informed, latent, and true preferences: As a result they face crucial methodological, epistemological, and practical objections, and cannot show how their approach enhances individual welfare. By building on the concepts of R. Sugden and C. Schubert, I develop an alternative normative framework for behavioural public policy, based on a contractualist perspective in which people may consent to collective choice rules in order to align future behaviour with values, to achieve particular goals or to preserve personal integrity. Individual consent and citizens’ participation and deliberation are crucial to this approach. This contractualist approach may provide a normative justification for behavioural public policy, and help to reconcile behavioural and normative economics. (shrink)
